If situation doesn’t change, president will be forced to declare state of emergency – Volodymyr Tsybulko warns

The parliamentary union of BYUT and NUNS can still be saved, political expert Volodymyr Tsybulko believes. If, following Sept. 2 BYUT vote against the president, Tymoshenko gets sober and her faction does not vote with the Regions to override Yushchenko’s veto on Sept.2 laws as well as back NUNS-proposed resolution in support of Georgia, the coalition can survive.

Besides, Tymoshenko must refrain from any statements or legislative moves in VR without NUNS consent. Tymoshenko even has no chance to push for Baloha’s resignation as the limit of her demands has expired, Tsybulko told ZIK Sept. 3.

According to him, Tymoshenko is gripped by fear to lose her premiership, even more so than to lose her voters – judging by her Sept. 2 tactics. “She has irrevocably lost her pro-Ukrainian patriotic voters, and she will try to take steps to retain her post. Yesterday, there was a definite attempt to stage a state coup, he added.

Failing to agree to a compromise, Tymoshenko will be faced with the fate of N. Vitrenko – being sidelined in politics.

Another scenario to make peace with NUNS is possible: the dissolution of VR and snap elections. This scenario will be justified in a sense that the present VR line-up does not meet security and European integration challenges for Ukraine. “It happened so that Ukrainians have become more pro-European in their evaluations, while Ukrainian politicians, amid their backstage dealing and wheeling, have failed to notice that the electorate has changed. If the situation does not change for the better, there may be public protests or even a declaration of the state of emergency by Yushchenko and VR dissolution, followed by direct presidential rule and parliamentary elections” the expert warned.

It will take 10 days before the present majority can be invalidated. Then, another 30 days are given by the constitution to form a new coalition. The incumbent will stick rigorously to this procedural framework, the expert warns. “If BYUT and Regions announce a new coalition, they will become deadly enemies within a couple of days. Most likely, a new coalition will include pragmatically-minded lawmakers from BYUT, NUNS, Regions – but excluding odious political figures,” Tsybulko forecasts.

Sept. 2, by an overwhelming majority VR passed the law on the Constitutional Court. The law, authored by BYUT’s Portnov and Regions’ Lavrynovych, simplifies the procedure for impeaching the president.

VR also passed the law on the cabinet, supported by 172 Regions lawmakers, 154 BYUT’s, 10 NUNS’ and 27 Communist lawmakers.

The law makes the cabinet less dependent on the president. As of Sept. 2, the cabinet:

- will not have to agree with the incumbent the sacking of ministers,

- will not have to obligatorily implement presidential decrees,

- will not have to draft bills as instructed by the president.

The decisions of the National Defense and Security Council will not be mandatory for the cabinet any longer.
